Absolutely.
There's much more to consider here...Eric's experience is certainly unfortunate, and the mount *was* not working properly when he got it, BUT -- the previous owner admitted to only using it once, and had done no imaging. It's entirely possibile that the previous owner did not know about any problems.
Let's not jump up and hang somebody when all of the facts are not known, let's just be glad that Eric's getting hs problem solved under warranty and be glad for him :)
